Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, applications, prediction markets, trading interfaces, market data, account tools, crypto deposit and withdrawal functionality, APIs, and related services provided by EVPMARKET (collectively, the “Platform” or “Services”).
Please read these Terms carefully. By accessing or using EVPMARKET, creating an account, placing an order, entering into a position, depositing crypto assets, withdrawing crypto assets, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, Risk Disclosure, AML Policy, Restricted Jurisdictions Policy, market rules, and any other policies or notices published by EVPMARKET from time to time.
If you do not agree to these Terms, you must not access or use the Services.
1. Platform Operator
EVPMARKET operates as a prediction market and trading platform.
The Platform allows eligible users to access event-based prediction markets and related trading functionality. The availability of specific products, markets, services, features, and crypto assets may depend on your jurisdiction, account status, verification level, and applicable law.
Trading predictions involves substantial risk and may result in the loss of capital. By using the Platform, you acknowledge that you understand these risks and agree to use the Services at your own discretion and responsibility.
2. Eligibility
You may use the Services only if you:
- are at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher;
- have full legal capacity to enter into these Terms;
- are not prohibited from using the Services under any applicable law, regulation, sanctions program, court order, or contractual restriction;
- are not located in, resident in, incorporated in, or accessing the Platform from a restricted jurisdiction;
- are not subject to sanctions or included on any applicable sanctions list, watchlist, or restricted persons list;
- are using the Services on your own behalf and not on behalf of any undisclosed third party;
- are not using the Services for illegal, fraudulent, manipulative, abusive, or prohibited activity.
EVPMARKET may refuse registration, restrict access, suspend accounts, or terminate accounts at its sole discretion where required by law, regulation, compliance obligations, risk controls, or internal policy.
3. Account Registration
To access certain Services, you may be required to create an account.
You agree to provide accurate, complete, current, and truthful information during registration and throughout your use of the Platform. You must promptly update your information if it changes.
You are responsible for maintaining the confidentiality and security of your login credentials, devices, passwords, two-factor authentication methods, private keys, payment credentials, wallet access, and any other account access tools.
You are responsible for all activity that occurs under your account, whether authorized by you or not, unless caused directly by EVPMARKET’s proven misconduct.
You must notify EVPMARKET immediately if you suspect unauthorized access, account compromise, incorrect account activity, or any security breach.
4. One Account Per User
Unless expressly permitted by EVPMARKET, each user may maintain only one account.
You must not create, use, control, or assist in the creation or use of multiple accounts for the purpose of avoiding limits, bypassing compliance controls, manipulating markets, abusing rewards, hiding identity, or engaging in any prohibited activity.
EVPMARKET may suspend, consolidate, restrict, or close accounts that it reasonably believes are duplicate, related, controlled by the same person, or used in coordination with other accounts.
5. Verification and KYC
EVPMARKET may require identity verification, age verification, location verification, sanctions screening, source of funds checks, source of wealth checks, wallet screening, or other compliance checks before allowing access to certain Services, before crypto deposits or withdrawals, or at any time during your use of the Platform.
You agree to provide all information and documents reasonably requested by EVPMARKET or its service providers.
This may include:
- full legal name;
- date of birth;
- country of residence or citizenship;
- residential address;
- email address and phone number;
- government-issued identification;
- proof of address;
- crypto wallet information;
- source of funds or source of wealth information;
- additional documents or explanations relating to your activity.
Failure to complete verification may result in account restrictions, withdrawal delays, suspension, termination, or refusal to provide Services.
6. Restricted Jurisdictions and Sanctions
You must not access or use the Services if you are located in, resident in, incorporated in, or accessing the Platform from a jurisdiction where use of the Services is prohibited by applicable law, regulation, sanctions, or EVPMARKET policy.
You must not use VPNs, proxies, remote access tools, false information, device manipulation, location masking, or any other method to bypass geo-blocking, jurisdiction controls, sanctions screening, or eligibility checks.
EVPMARKET may use IP address data, device information, geolocation data, timezone data, wallet data, blockchain analytics, identity verification tools, and other risk indicators to determine whether access is permitted.
EVPMARKET may block, restrict, suspend, terminate, or report accounts where restricted jurisdiction or sanctions concerns are identified.
7. Nature of the Services
EVPMARKET provides access to prediction markets, trading interfaces, event-based contracts, market data, account tools, settlement information, crypto deposit and withdrawal functionality, and related services.
The specific products and markets available to you may depend on your jurisdiction, account status, verification level, and applicable law.
EVPMARKET does not guarantee that any market, contract, event, feature, crypto asset, trading function, deposit function, or withdrawal function will be available at all times or in all jurisdictions.
EVPMARKET may add, modify, suspend, restrict, settle, cancel, or remove markets, products, features, crypto assets, or services at any time where necessary for legal, regulatory, operational, security, risk, integrity, or business reasons.
8. No Financial, Legal, Tax, or Investment Advice
EVPMARKET does not provide financial, investment, legal, tax, trading, or other professional advice.
Any information provided through the Platform, including market data, prices, probabilities, charts, event descriptions, educational content, communications, or settlement information, is provided for general informational purposes only.
You are solely responsible for evaluating whether any trade, prediction, market, position, crypto deposit, crypto withdrawal, or use of the Services is suitable for you.
You should consult your own professional advisors where appropriate.
9. Trading Risk
Trading predictions involves substantial risk and may result in the loss of all capital committed to a market or position.
You acknowledge and agree that:
- market prices may be volatile;
- liquidity may be limited or unavailable;
- orders may not execute;
- executed trades may not be reversible;
- event outcomes may be uncertain, delayed, disputed, or difficult to verify;
- settlement may depend on third-party data sources, market rules, or resolution criteria;
- technical failures, market disruptions, or data errors may affect trading;
- crypto asset values may fluctuate significantly;
- blockchain transactions may be irreversible;
- you are solely responsible for your trading decisions and losses.
You must not trade with funds you cannot afford to lose.
10. Orders, Trades, and Positions
You are responsible for reviewing all order details before submission.
Once submitted, an order may be executed, partially executed, rejected, expired, cancelled, or otherwise processed according to the Platform’s rules and system functionality.
Once a trade is executed, it is final unless EVPMARKET determines that cancellation, reversal, adjustment, or correction is necessary due to error, fraud, market manipulation, legal requirement, technical issue, settlement issue, or violation of these Terms.
EVPMARKET does not guarantee execution, price, liquidity, market availability, or the ability to enter or exit any position.
11. Market Rules and Settlement
Each market may be subject to specific rules, event descriptions, resolution criteria, settlement sources, deadlines, and procedures.
By trading in a market, you agree to the rules applicable to that market.
EVPMARKET may rely on third-party data providers, official sources, public records, news sources, blockchain data, oracle providers, or other information sources to determine market outcomes.
EVPMARKET may delay settlement, modify settlement procedures, void a market, cancel trades, or take other action where:
- the event outcome is unclear;
- the market was created with an error;
- the market description was ambiguous;
- the settlement source becomes unavailable or unreliable;
- suspicious, manipulative, or abusive activity is detected;
- required by law, regulation, court order, regulator, or competent authority;
- necessary to protect market integrity.
Where EVPMARKET makes a market settlement decision, such decision will be made in good faith and in accordance with applicable market rules.
12. Creator Studio and User-Created Markets
The Creator Studio allows eligible verified users (“Creators”) to submit their own event markets for publication on the Platform. Submitting a market does not guarantee publication.
Every submitted market is subject to review by EVPMARKET. EVPMARKET may approve, reject, edit, delay, relabel, recategorise, delist, or void any submitted market at its sole discretion, before or after publication.
12.1 Requirements for a submitted market
A market submitted through the Creator Studio must:
- be written in English, in both its question and its description;
- describe a single, specific, future event whose outcome is not yet known to the Creator or to the public at the time of submission;
- state objectively verifiable resolution criteria, including the outcome that resolves the market and the deadline by which it must occur;
- be resolvable from a public, reputable, and independently checkable source, such as an official announcement, exchange data, regulatory filing, election authority, or recognised sports or news organisation;
- use a cover image that the Creator owns or is lawfully licensed to use;
- be assigned to a category that accurately reflects its subject matter.
12.2 Prohibited markets
You must not submit, and EVPMARKET will not publish, any market that:
- concerns the death, injury, illness, disappearance, arrest, or physical harm of any identified or identifiable person;
- concerns acts of terrorism, violence, war crimes, mass casualties, or other atrocities, or that could create a financial incentive for such acts;
- concerns the sexual conduct, sexual orientation, gender identity, medical condition, religion, or other sensitive personal data of an identifiable private individual;
- targets, defames, harasses, threatens, or intimidates any person or group, or that promotes hatred or discrimination on the basis of a protected characteristic;
- relates to any person under the age of 18;
- discloses or relies on non-public, confidential, privileged, stolen, insider, or unlawfully obtained information;
- has an outcome that the Creator, or any person acting with the Creator, is able to influence, determine, or control;
- is intentionally ambiguous, unverifiable, unfalsifiable, subjective, or drafted so that more than one outcome can be argued after the fact;
- duplicates an existing market on the Platform, or is submitted in bulk, as spam, or to distort category feeds;
- promotes, advertises, or solicits for a third-party product, service, token, offering, or website;
- infringes any copyright, trademark, publicity, privacy, or other third-party right, including in its cover image;
- is unlawful in any jurisdiction in which the Platform is offered, or would require the Platform to hold a licence, registration, or authorisation it does not hold;
- is otherwise contrary to these Terms, applicable market rules, or market integrity.
Creators are solely responsible for the content they submit, including the accuracy of the question, the description, the resolution criteria, and any image.
12.3 Settlement of created markets
Markets published through the Creator Studio are resolved by EVPMARKET, not by the Creator. The Creator has no role in settlement and may not instruct, influence, or challenge the settlement of a market on the basis of having created it.
EVPMARKET may void a created market and cancel the associated trades where the market meets any condition set out in the section on Market Rules and Settlement, or where it breaches this section.
Fees paid to submit or upgrade a market are not refundable where the market is rejected, voided, or removed because of a breach of these Terms.
12.4 Creator earnings
Where a market published by a Creator is traded and settles, the Creator may earn a creator fee calculated as a percentage of the winning volume of that market, at the rate published in the Creator Studio at the time the market was created.
Creator earnings accrue only after the relevant market has been finally resolved. Earnings attributable to a market that is voided, cancelled, or removed do not accrue and, where already credited, may be reversed.
Creator earnings are held as a creator balance. Transferring that balance to your tradable cash balance does not constitute a withdrawal and does not on its own entitle you to a payout.
Before any funds derived from creator earnings may be withdrawn from the Platform, you must:
- have completed identity verification (KYC) as described in the section on Verification and KYC; and
- have made at least one completed crypto deposit to your account on the Platform.
Both conditions apply in addition to, and not instead of, the conditions set out in the section on Crypto Withdrawals. EVPMARKET may withhold, reverse, or forfeit creator earnings obtained through prohibited activity, self-trading, collusion, multiple accounts, wash trading, manipulation of a market you created, or any other breach of these Terms.
12.5 Licence to submitted content
By submitting a market, you grant EVPMARKET a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt, translate, and distribute the market question, description, and cover image in connection with the Platform and its promotion. You confirm that you hold all rights necessary to grant this licence.
13. Crypto Deposits
At this stage, the Platform supports crypto deposits only. Fiat deposits are not currently supported unless expressly made available by EVPMARKET.
You may deposit crypto assets only from wallets that you own or lawfully control.
You must not deposit crypto assets that are derived from illegal activity, fraud, theft, hacks, scams, ransomware, sanctions evasion, money laundering, terrorist financing, darknet markets, mixers, tumblers, or any other unauthorized or high-risk source.
EVPMARKET may impose minimum and maximum deposit limits, supported asset lists, supported network lists, confirmation requirements, wallet screening requirements, and other conditions.
You are responsible for ensuring that you send only supported crypto assets using supported blockchain networks. EVPMARKET is not responsible for losses caused by sending unsupported assets, using unsupported networks, entering incorrect addresses, or making irreversible blockchain transactions.
EVPMARKET may refuse, delay, reject, freeze, reverse where technically possible, or restrict deposits where required by law, regulation, compliance policy, blockchain analytics results, risk controls, or these Terms.
14. Crypto Withdrawals
Where withdrawals are available, withdrawals may be made only to crypto wallets that you own or lawfully control.
EVPMARKET may require identity verification, wallet verification, source of funds checks, enhanced due diligence, sanctions screening, blockchain analytics screening, or other compliance checks before processing any withdrawal.
EVPMARKET may refuse, delay, restrict, or block a withdrawal where:
- the requested wallet is high-risk or associated with suspicious activity;
- the withdrawal may violate sanctions, AML rules, or applicable law;
- your account is under review;
- your identity or ownership of the wallet has not been verified;
- the withdrawal appears connected to fraud, manipulation, account compromise, or prohibited activity;
- required by a regulator, law enforcement agency, court, payment partner, blockchain analytics result, or competent authority.
You are responsible for ensuring that all withdrawal addresses, networks, and instructions are accurate. Blockchain transactions may be irreversible.
For anti-money laundering compliance, the Company reserves the right to request a one-time refundable wallet verification deposit for addresses not yet whitelisted. The deposit will be credited to the user’s balance immediately.
15. Taxes
You are solely responsible for determining, reporting, withholding, collecting, and paying any taxes, duties, levies, or governmental charges that may apply to your use of the Services, trading activity, profits, losses, deposits, withdrawals, crypto transactions, or other Platform activity.
EVPMARKET does not provide tax advice.
For withdrawals exceeding certain thresholds, the Company may be required to collect and remit withholding tax in accordance with applicable laws. Such tax must be funded via a separate deposit from the user’s verified wallet to satisfy audit trail requirements.
16. Prohibited Activity
You must not use the Services to:
- violate any law, regulation, sanctions program, court order, or third-party right;
- engage in money laundering, terrorist financing, fraud, theft, scams, or other unlawful activity;
- manipulate or attempt to manipulate any market, price, volume, order book, settlement process, or event outcome;
- engage in wash trading, spoofing, layering, collusion, self-trading, front-running, insider trading, or other abusive trading practices;
- use non-public, confidential, stolen, or unlawfully obtained information to trade;
- create or use multiple accounts to evade limits, controls, restrictions, or monitoring;
- use bots, scrapers, automated tools, APIs, or other systems in a manner not authorized by EVPMARKET;
- interfere with or disrupt the Platform, servers, networks, APIs, data feeds, or security systems;
- bypass geo-blocking, sanctions screening, verification, or compliance controls;
- use another person’s identity, account, wallet, payment method, or credentials;
- submit false, misleading, incomplete, or fraudulent information;
- exploit bugs, errors, latency, settlement mistakes, or technical vulnerabilities;
- deposit or withdraw crypto assets connected to mixers, tumblers, darknet markets, stolen funds, hacks, ransomware, scams, sanctioned wallets, or other high-risk sources;
- harass, threaten, abuse, or harm EVPMARKET, its users, employees, vendors, or partners;
- use the Services for any purpose that EVPMARKET determines to be abusive, harmful, unlawful, or inconsistent with market integrity.
EVPMARKET may investigate suspected prohibited activity and take any action it considers appropriate, including account suspension, trade cancellation, withdrawal restriction, account closure, reporting to authorities, or legal action.
17. Market Integrity and Conflicts
You must not trade in any market where you possess material non-public information, confidential information, privileged information, or the ability to directly influence the outcome of the underlying event, unless expressly permitted by applicable market rules and law.
You must not trade on behalf of another person or coordinate trading activity with others to manipulate prices, settlement, liquidity, or market outcomes.
EVPMARKET may restrict users, accounts, markets, orders, or positions where conflicts of interest, integrity concerns, or manipulation risks are identified.
18. Fees
EVPMARKET may charge fees for trading, deposits, withdrawals, market activity, inactivity, crypto network costs, blockchain transaction costs, or other Services.
Applicable fees may be displayed on the Platform or communicated separately.
EVPMARKET may change fees at any time, subject to applicable law.
Blockchain networks, wallet providers, infrastructure providers, or other third parties may charge additional fees for which EVPMARKET is not responsible.
19. Errors and Corrections
EVPMARKET may correct, reverse, cancel, void, or adjust any order, trade, position, balance, market, settlement, deposit, withdrawal, reward, fee, or other Platform activity where it determines that an error occurred.
Errors may include:
- technical errors;
- pricing errors;
- display errors;
- settlement errors;
- market description errors;
- data source errors;
- calculation errors;
- blockchain processing errors;
- system or infrastructure failures;
- unauthorized or fraudulent activity.
You must notify EVPMARKET promptly if you become aware of any error.
You must not knowingly exploit any error, bug, vulnerability, incorrect price, incorrect settlement, or system malfunction.
20. Platform Availability
EVPMARKET does not guarantee that the Platform will be uninterrupted, error-free, secure, or available at all times.
The Services may be unavailable or limited due to maintenance, upgrades, technical issues, cyberattacks, market disruptions, blockchain network congestion, third-party failures, legal requirements, regulatory requests, or circumstances beyond EVPMARKET’s control.
EVPMARKET is not liable for losses resulting from downtime, delays, degraded performance, connectivity issues, order failures, data issues, blockchain network issues, or inability to access the Platform, except to the extent required by applicable law.
21. Third-Party Services and Data
The Platform may rely on or provide access to third-party services, including wallet infrastructure, blockchain networks, identity verification providers, blockchain analytics tools, market data providers, event data sources, oracle providers, hosting providers, analytics services, and external websites.
EVPMARKET does not control and is not responsible for third-party services, content, data, failures, delays, fees, policies, or actions.
Your use of third-party services may be subject to additional terms and policies.
22. Intellectual Property
The Platform, software, website, interfaces, APIs, databases, market designs, text, graphics, logos, trademarks, service marks, content, documentation, and all related intellectual property are owned by EVPMARKET, its affiliates, or its licensors.
Subject to these Terms, EVPMARKET grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or permitted business use.
You must not copy, reproduce, modify, reverse engineer, decompile, disassemble, scrape, distribute, sell, lease, sublicense, create derivative works from, or otherwise exploit any part of the Platform except as expressly permitted by EVPMARKET.
23. API and Automated Access
If EVPMARKET provides API access or permits automated access, you must comply with all API rules, rate limits, technical requirements, and usage policies.
EVPMARKET may suspend or revoke API access at any time.
You must not use automated systems to overload the Platform, manipulate markets, bypass restrictions, extract unauthorized data, interfere with other users, or violate these Terms.
24. Privacy
Your use of the Services is subject to the Privacy Policy.
By using the Services, you acknowledge that EVPMARKET may collect, process, store, share, and transfer your personal information as described in the Privacy Policy and as necessary for compliance, security, fraud prevention, identity verification, wallet screening, legal obligations, and Platform operation.
25. Suspension and Termination
EVPMARKET may suspend, restrict, or terminate your account or access to the Services at any time if:
- you breach these Terms or any Platform policy;
- you violate applicable law or regulation;
- you fail to complete verification;
- you provide false or misleading information;
- your activity is suspicious, abusive, manipulative, or prohibited;
- your account presents legal, regulatory, sanctions, fraud, security, or reputational risk;
- required by a regulator, court, law enforcement agency, payment provider, blockchain analytics provider, or competent authority;
- necessary to protect EVPMARKET, users, markets, counterparties, or Platform integrity.
Upon suspension or termination, EVPMARKET may restrict deposits, withdrawals, trading, market access, account access, API access, or other functionality.
Where permitted by law and internal policy, EVPMARKET may allow withdrawal of remaining eligible balances after completion of applicable checks and resolution of outstanding obligations.
26. Indemnification
You agree to indemnify, defend, and hold harmless EVPMARKET, its affiliates, directors, officers, employees, contractors, agents, service providers, licensors, and partners from and against any claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising out of or related to:
- your use of the Services;
- your breach of these Terms;
- your violation of law, regulation, or third-party rights;
- your prohibited activity;
- your trading activity, orders, positions, deposits, withdrawals, tax obligations, or crypto transactions;
- your misuse of the Platform or account credentials.
27. Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, EVPMARKET disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.
EVPMARKET does not warrant that:
- the Services will meet your expectations;
- the Platform will be uninterrupted, secure, or error-free;
- market data or event information will be accurate, complete, or timely;
- orders will execute at any particular price or time;
- any market will have liquidity;
- any crypto asset or blockchain network will remain available;
- any error will be corrected;
- the Services will be available in any jurisdiction.
28. Limitation of Liability
To the maximum extent permitted by law, EVPMARKET and its affiliates, directors, officers, employees, contractors, agents, service providers, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including loss of profits, loss of revenue, loss of trading opportunity, loss of data, loss of goodwill, business interruption, market losses, crypto asset losses, blockchain transaction losses, or loss of capital, whether based on contract, tort, negligence, strict liability, or any other legal theory.
To the maximum extent permitted by law, EVPMARKET’s total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of: (i) the fees paid by you to EVPMARKET in the three months preceding the event giving rise to the claim; or (ii) USD 100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
29. Amendments
EVPMARKET may update, modify, or replace these Terms at any time.
Updated Terms may be posted on the Platform or communicated by other reasonable means. Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Services.
30. Complaints and Support
If you have a question, complaint, or dispute regarding the Services, you may contact EVPMARKET at:
EVPMARKET will use reasonable efforts to review and respond to complaints, but does not guarantee any specific outcome unless required by applicable law.
31. Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be governed by the laws of the Republic of Lithuania, without regard to conflict of law principles.
Unless otherwise required by applicable law, you agree that disputes shall be resolved exclusively in the competent courts of the Republic of Lithuania.
EVPMARKET may seek injunctive, equitable, or protective relief in any court of competent jurisdiction where necessary to protect its rights, users, markets, systems, intellectual property, confidential information, or Platform integrity.
32. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
33. Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent from EVPMARKET.
EVPMARKET may assign, transfer, delegate, or subcontract its rights or obligations under these Terms without restriction, including to an affiliate, successor, acquirer, or operator of any part of the Services.
34. Entire Agreement
These Terms, together with the Privacy Policy, Risk Disclosure, AML Policy, Restricted Jurisdictions Policy, market rules, and any other policies referenced herein, constitute the entire agreement between you and EVPMARKET regarding the Services.
They supersede all prior or contemporaneous agreements, communications, representations, or understandings relating to the Services.
